Fresenius Medical Care AG & Co. KGaA (FMS) announced that it would file appeal against trial court's award of $14.3 million in damages on sale of hemodialysis machines and disposables through October 2007 related to a patent infringement case filed by Baxter International Inc. The company said it plans to appeal to the Court of Appeals for the Federal Circuit to have the original jury verdict of invalidity reinstated and to seek a stay of the injunction pending resolution of the appeal. More.
